Agreement to these Terms
By using BrillSync, submitting a Studio order, or accepting these Terms before payment, you agree to these Terms, acknowledge the Privacy Policy, and accept the Refund Policy. If you do not agree, do not submit payment.
Eligibility and accurate information
You must be legally able to enter a binding contract. BrillSync is not directed to children under 13. If you are under the age of legal majority where you live, a parent or legal guardian must authorize your use and accept these Terms.
You are responsible for providing accurate Tesla model, model year, software, Pedestrian Warning System (PWS), powered-liftgate, and other customer-confirmed compatibility information requested by the Studio. BrillSync does not access your Tesla account or vehicle telemetry to independently verify those statements.
Your audio and content
You retain your rights in audio and other content you provide. You grant BrillSync and the service providers needed to operate BrillSync a limited, non-exclusive license to receive, copy, transform, analyze, validate, package, store, transmit, and delete that content as needed to provide, secure, troubleshoot, and support the purchased service.
You represent that you own the content or have all permissions required to upload it, process it, and use the resulting files. BrillSync does not grant music licenses or public-performance, synchronization, broadcast, or other third-party intellectual-property rights.
Automated generation and compatibility
BrillSync is an automated digital service. The selected product, Tesla profile, customer confirmations, normalized audio, validation rules, and current BrillSync software determine the output. BrillSync may reject an unsupported combination before payment or safely limit generation to supported capabilities.
Custom Light Show availability varies by Tesla model, model year, hardware, software, firmware, region, and current Tesla behavior. Full Motion may use supported powered closures or accessories only when the selected vehicle profile and safety rules permit it. External sound products require customer-confirmed PWS/Boombox availability where applicable.
Tesla, Model S, Model 3, Model X, Model Y, Cybertruck, Boombox, and related marks belong to Tesla, Inc. BrillSync is an independent service and is not affiliated with, endorsed by, or sponsored by Tesla, Inc.
Vehicle and Full Motion safety
Use Light Show only while the vehicle is safely parked with adequate clearance and in compliance with applicable law. Do not use Light Show on or near public roads where it may distract other road users. Follow the vehicle manufacturer’s current instructions and warnings.
Full Motion can move supported vehicle parts, including windows, mirrors, charge ports, door handles, doors, liftgates, or other closures. Before every run, use a level, open area; keep people, children, pets, clothing, charging equipment, ceilings, walls, vehicles, and other objects clear; remain able to stop the show; and stop use immediately if behavior is unexpected.
Do not use Full Motion where movement could cause contact, entrapment, property damage, distraction, or injury. Boombox and other external-sound features must be used only where supported by the vehicle and law; Tesla states that Boombox uses the PWS speaker while the vehicle is in Park and advises users to check local laws for public use.
One-time purchases and payment
BrillSync Studio currently sells supported launch products as one-time digital purchases. The Studio displays item prices and an order total before checkout, and the BrillSync server independently rebuilds and confirms the product, vehicle, price, currency, and total before a Stripe payment session is created. Browser-supplied prices are not payment authority.
Stripe securely provides the embedded card-entry experience. BrillSync does not receive or store your full payment-card number. Completing the payment form is not, by itself, treated as proof of payment. BrillSync begins paid fulfillment only after its backend verifies the signed Stripe payment event and authoritative order state.
Applicable taxes, if any, will be handled according to the configuration and legal obligations in effect at checkout.
Refunds and failed delivery
The Refund Policy is part of these Terms and is disclosed before payment. Because BrillSync creates customized digital output, an order is generally non-refundable after verified payment causes automated processing or fulfillment to begin, except where required by law or as stated in the Refund Policy.
If BrillSync cannot deliver a purchased package after its applicable automated recovery process, contact Support with the order reference. BrillSync may retry fulfillment or, when appropriate, refund the affected undelivered item. Rights that cannot legally be waived remain unaffected.
Acceptable use
You may not use BrillSync to violate law or third-party rights; submit malware; interfere with the service; bypass access, pricing, payment, vehicle, or safety controls; probe for vulnerabilities without authorization; impersonate another person; access another customer’s private delivery; or use generated files in a manner that is unsafe, deceptive, harmful, or prohibited by the vehicle manufacturer or applicable law.
Suspension and service protection
BrillSync may block or limit a request when necessary to address fraud, chargebacks, security risk, abuse, unsafe behavior, unlawful activity, unsupported vehicle combinations, or threats to the service or other users.
Service availability and disclaimers
To the extent permitted by law, BrillSync is provided on an “as is” and “as available” basis. BrillSync does not promise uninterrupted availability, compatibility with every Tesla configuration or software version, identical creative results, or continued availability of a vehicle feature that Tesla changes or removes.
Limitation of liability
To the maximum extent permitted by law, BrillSync will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business interruption, or property damage arising from use of the service. BrillSync’s aggregate liability for a claim will not exceed the amount paid for the BrillSync order giving rise to that claim. Some jurisdictions do not permit every limitation, so applicable rights may vary.
Changes
BrillSync may update these Terms for legal, safety, security, product, or operational changes. The effective date will be revised when the Terms change. A customer is bound by the version presented and accepted for the applicable order, subject to rights provided by law.
